Letter before action template
When reminders haven't worked, a formal letter before action is the last step before court. Fill in the details and get a ready-to-send letter for an unpaid invoice.
Before you send it
- Individuals and sole traders: in England and Wales, follow the Pre-Action Protocol for Debt Claims — give at least 30 days and include the Information Sheet, Reply Form and Financial Statement from the protocol.
- Companies: 14 days is usual.
- Send it by post and email, and keep a copy and proof of sending.
- If they reply disputing the work, try to resolve it before going further.
If the letter doesn't work, you can claim online through Money Claim Online on GOV.UK. Read how to chase an unpaid invoice for the full process.
This template is general information for England and Wales, not legal advice. Scotland and Northern Ireland have different procedures.
Most invoices never get this far
PaySorted sends polite reminders automatically from before the due date, by email and text — and on the Pro plan it creates this letter for you from the invoice, if it's ever needed.

How long do I have to give them to pay?
For individuals and sole traders, at least 30 days under the Pre-Action Protocol for Debt Claims. For companies, 14 days is usual.
Do I need a solicitor to send one?
